Each restricted party list provides specific information on applicable restrictions.\r\n\r\nCertain research and educational activities that involve restricted parties may be prohibited or may require the University to first obtain a license before engaging in the activity. For example, the University or an individual may not export even low technology tangible items (or non-fundamental research technology or software) to an entity identified on the U.S. Department of Commerce\u2019s Entity List without first obtaining an export license.\r\n\r\nThe U.S. Government regularly updates restricted party lists, and sometimes new restricted party lists are created. In order to screen effectively, the University must review the most current information available on whether or not a party is subject to U.S. Government restrictions.","background_color":"#f4f4f4","width":"width-medium","columns":"1","cards":[{"card_title":"<h5>Important note<\/h5>","card_text":"Various universities and research institutes in other countries appear on U.S. Government restricted party lists, and strict restrictions may be applicable to collaborations or activities with those entities.","card_background_color":"#FFFFFF","card_hover_color":"transparent","card_link":"","card_hover_arrow":"","card_image":"","card_image_size":"","card_image_placement":"","card_image_hover_state":"hover_fade","card_image_link":""}]},{"acf_fc_layout":"text","anchor":"","css_class":"pt-0","title":"","content":"The University recommends that restricted party screening be done <em>prior to<\/em> engaging with foreign parties, including activities involving:\r\n<ul>\r\n \t<li>formal or informal research collaborations, including those proposed in grant applications,<\/li>\r\n \t<li>accepting certain affiliations or association with foreign institutions (as described in our <a href=\"https:\/\/www.rochester.edu\/university-research\/compliance\/research-security\/international-appointments-affiliations\/\">international appointment and affiliations guidance<\/a>),<\/li>\r\n \t<li>exporting physical items, software, or technology,<\/li>\r\n \t<li>entering into MOUs or agreements, and\/or<\/li>\r\n \t<li>inviting a visiting student or scholar (described further below).<\/li>\r\n<\/ul>\r\nIf your arrangement falls into one of these categories above, please contact either the University\u2019s Export Control Officer, Nicole Porter (<a href=\"mailto:export@rochester.edu\">export@rochester.edu<\/a>) or <a href=\"https:\/\/www.rochester.edu\/global\/aboutus\/\">Global Engagement<\/a> to perform restricted party screening through <a class=\"u-link-external\" href=\"https:\/\/www.visualcompliance.com\/\">Visual Compliance<\/a>. Visual Compliance is a commercially available online tool that screens against a comprehensive list of restricted parties.","background_color":"#f4f4f4","width":"width-medium"},{"acf_fc_layout":"card_grid","anchor":"","css_class":"pb-45","title":"<h2>OFAC sanctions<\/h2>","description":"The Office of Foreign Assets Control (OFAC) is part of the United States Department of the Treasury and administers several sanctions programs. OFAC sanctions can be either comprehensive or selective. For a complete list of the OFAC sanctions, please review <a class=\"u-link-external\" href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/Programs\/Pages\/Programs.aspx\">OFAC Sanctions Programs and Country Information<\/a>.\r\n\r\nThe following are subject to comprehensive OFAC sanctions: <strong>Cuba, Iran, North Korea, Syria, and the following regions of Ukraine: Crimea, Donetsk, and Luhansk, and Russia*<\/strong>. Faculty are strongly encouraged to register travel (individually or completed by department) in the University\u2019s <a href=\"https:\/\/studyabroad.rochester.edu\/index.cfm?FuseAction=Abroad.ViewLink&amp;Parent_ID=0&amp;Link_ID=233ED0E7-5056-BA1F-71CF08B7F507EA64\">travel registry system<\/a>.","background_color":"#f4f4f4","width":"width-medium"},{"acf_fc_layout":"text","anchor":"","css_class":"","title":"<h2>International visitors<\/h2>","content":"International visitors to the University can be an export compliance risk. For example, visitors may themselves be or are associated with a restricted party, may be a citizen of a comprehensively sanctioned country, or may be engaging in research activity that is subject to export control laws.\r\n\r\nOffices within the Office of Global Engagement coordinate the application and onboarding process for all <a href=\"https:\/\/www.rochester.edu\/global\/visitors\/visiting-students\/\">international visiting students<\/a>, including restricted party screening.\r\n\r\nFor visiting faculty and other researchers, departments and hosts should contact the <a href=\"https:\/\/iso.rochester.edu\/\">International Services Office<\/a> early in the process to assist with obtaining the appropriate visa, or the Office of Global Engagement if there are questions regarding how the visitor should be categorized. For those individuals that the International Services Office assists in obtaining a visa, restricted party screening will occur during the onboarding process.\r\n\r\nThe Laboratory for Laser Energetics (LLE) follows visitor processes in compliance with Department of Energy requirements. Departments and hosts should contact LLE with any questions regarding international visitors to LLE.","background_color":"#ffffff","width":"width-medium"},{"acf_fc_layout":"accordion_new","anchor_id":"","classes":"","title":"<h2>Overview of export compliance under the ITAR and EAR<\/h2>","description":"For purposes of research security, the primary U.S. export control laws to consider include:\r\n<ul>\r\n \t<li><a class=\"u-link-external\" href=\"https:\/\/www.pmddtc.state.gov\/ddtc_public\/ddtc_public?id=ddtc_public_portal_itar_landing\">International Traffic in Arms Regulations (ITAR)<\/a>: U.S. Department of State; and<\/li>\r\n \t<li><a class=\"u-link-external\" href=\"https:\/\/www.bis.doc.gov\/index.php\/regulations\/export-administration-regulations-ear\">Export Administration Regulations (EAR)<\/a>: U.S. Department of Commerce.<\/li>\r\n<\/ul>\r\nLearn more about each of these laws, examples, and common compliance issues in the drop-downs below.","background":"decorative","background_color":"#ffffff","style":"row_blank","expand":"yes","accordions":[{"acf_fc_layout":"accordion","accordion_title":"ITAR","icon":"","row_content":"The International Traffic in Arms Regulations (ITAR) control defense articles and defense services. Everything subject to the ITAR should be reviewed by the Export Control Officer for export compliance. Immediately contact the University's Export Control Officer, Nicole Porter, (<a href=\"mailto:export@rochester.edu\">export@rochester.edu<\/a>), and Chris Deeney (<a href=\"mailto:cdeeney@lle.rochester.edu\">cdeeney@lle.rochester.edu<\/a>), the University\u2019s ITAR Empowered Official and Director of the Laboratory for Laser Energetics, if there is any chance that the University may engage in any activity involving the ITAR. ITAR controlled items are very high risk.\r\n\r\nExamples of how research activities may be subject to the ITAR include:\r\n<ul>\r\n \t<li>Receiving ITAR controlled technical data (even if only background information for a fundamental research project),<\/li>\r\n \t<li>Design and\/or development of a defense article,<\/li>\r\n \t<li>Access to ITAR controlled physical items or software, and<\/li>\r\n \t<li>Providing assistance to foreign persons in connection with a defense article.<\/li>\r\n<\/ul>","accordion_anchor":""},{"acf_fc_layout":"accordion","accordion_title":"EAR","icon":"","row_content":"The Export Administration Regulations (EAR) control items that are not exclusively controlled for export under other regulatory frameworks such as the ITAR, OFAC, the Nuclear Regulatory Commission and Department of Energy\u2019s respective export regulations.\r\n\r\nAn export under the EAR includes:\r\n<ul>\r\n \t<li>An actual shipment or transmission out of the U.S., including the sending or taking of an item out of the U.S., in any manner, and<\/li>\r\n \t<li>Releasing or otherwise transferring <em>technology<\/em> or <em>source code<\/em> (but not object code) to a foreign person in the U.S. (this is a \u201cdeemed export\u201d).<\/li>\r\n<\/ul>\r\nResearchers should understand that just because an activity constitutes an export under U.S. export control laws, it does not inherently mean an export license is required.
